Purpose of this disclosure

This Patient Disclosure and Informed Consent Policy summarizes the key facts you should understand before using Ody Health. By accessing the Ody Health platform and proceeding through the intake process, you acknowledge that you have read and understood the disclosures in this policy and in Ody Health’s full suite of published policies, including the Privacy Policy, HIPAA Notice of Privacy Practices, Compliance Policy, Prescription Validation and Handling Policy, Complaint Resolution and Patient Safety Policy, and Terms of Service.

This policy does not replace those documents. It provides a consolidated disclosure of the most important facts about how Ody Health operates and what you are consenting to when you use the platform.

Ody Health is a technology platform, not a medical practice

Ody Health is a technology and administrative platform. Ody Health is not a medical practice, clinic, pharmacy, or laboratory. Ody Health does not practice medicine, provide medical advice, prescribe medication, dispense medication, compound medication, or make clinical decisions of any kind.

All medical services available through Ody Health are provided exclusively by independent licensed clinicians affiliated with Ola Digital Health or other provider networks. All pharmacy services are provided by independent licensed pharmacies. All laboratory services are provided by independent laboratory facilities. These entities are legally separate from Ody Health and are solely responsible for their clinical, dispensing, and testing decisions.

Completing an intake form, purchasing a subscription, or requesting a protocol does not guarantee that you will receive a consultation, prescription, medication, lab order, diagnosis, or any particular clinical result. Providers exercise independent clinical judgment and may determine that a requested service, medication, or treatment is not appropriate for you.

Technical limitations and acknowledgment

Telehealth services depend on internet connectivity and telecommunications infrastructure. Disruptions to signals or internet connectivity may cause problems including poor picture or sound quality, dropped connections, and audio interference that prevent effective interaction between you and your provider. These disruptions are outside the control of Ody Health and Ola Digital Health.

By using Ody Health and accessing telehealth services through Ola Digital Health, you acknowledge and agree that Ola Digital Health and members of your care team are released and held harmless from any loss of data or information due to technical failures associated with the telehealth service. You also understand that the health information you provide at the time of a telehealth visit may be the only source of health information available to your provider during that visit, and that your provider may not have access to your full medical record or prior clinical history from outside Ody Health.

Key disclosures and acknowledgments

By using Ody Health, you acknowledge and agree to the following:

Independent providers: Your clinical relationship is with the independent licensed provider, not with Ody Health. The provider is responsible for all clinical decisions, prescriptions, diagnoses, and treatment recommendations. Ody Health does not direct, supervise, or control the provider’s clinical judgment.

No guarantee of clinical outcomes: Ody Health does not guarantee any particular clinical outcome, prescription, result, or improvement. Individual results vary. Providers determine clinical appropriateness based on your specific medical history and health status.

Compounded medications: Some protocols may involve compounded medications if prescribed by a provider. Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or quality in the same way as FDA-approved medications. AI-assisted intake: Ody Health uses an AI recommendation engine during portions of the intake process to generate a preliminary clinical assessment for physician review. Only de-identified information is transmitted to the AI system. Personal identifiers are never transmitted. All AI-generated assessments are reviewed by a licensed physician before any clinical decision is made. Accurate information: You are responsible for providing accurate and complete medical information during intake. False, incomplete, or misleading information may result in denial of services, cancellation of orders, or other appropriate action, and may create risks to your health.

Not for emergency use: Ody Health is not an emergency medical service. If you are experiencing a medical emergency, call 911 immediately. If you are experiencing a mental health emergency or have thoughts of suicide, call 988 or 911 immediately.

U.S. adults only: Ody Health is intended only for adults 18 years of age or older located in the United States.

Your right to refuse or withdraw consent

You have the right to refuse any service, medication, test, protocol, or clinical recommendation at any time. Refusal will not result in discrimination or retaliation by Ody Health.

You may withdraw your consent to telehealth services through Ola Digital Health at any time. Withdrawal does not affect any future services or care benefits to which you are entitled. To withdraw consent, contact your provider through the platform or contact Ody Health at info@odyhealth.co.

You may cancel your Ody Health subscription at any time through your account settings or by contacting info@odyhealth.co. Cancellation of your subscription does not automatically withdraw your consent to telehealth services or delete your health records, which are retained as required by law.
