Prescription overview

Prescriptions are issued only by independent licensed medical providers through their clinical judgment and evaluation of a patient. Ody Health is a technology and administrative platform that facilitates prescription transmission from providers to pharmacies for dispensing and fulfillment. Ody Health does not issue prescriptions, validate clinical appropriateness, determine dosages, or make clinical decisions about whether a prescription should be issued or filled.

This policy describes how Ody Health handles prescriptions as an intermediary platform, the responsibilities of independent providers and pharmacies, and compliance with applicable laws and regulations governing prescriptions.

Prescription issuance by independent providers

Prescriptions are issued only by independent licensed medical providers, including providers affiliated with Ola Digital Health or similar provider networks. The provider issues a prescription in the provider’s sole clinical judgment after evaluating the patient’s medical history, current health status, contraindications, drug interactions, and other relevant clinical factors.

Completing an intake form, paying for a subscription, or requesting a protocol does not guarantee that a provider will issue a prescription. A provider may determine that a patient is not eligible for a requested medication, that a different medication or dosage is more appropriate, or that no prescription is necessary.

Prescriptions are issued in accordance with applicable state and federal laws, including the Controlled Substances Act, state medical board regulations, state pharmacy laws, and telemedicine regulations specific to the patient’s state of residence.

Provider validation of prescriptions

Before issuing a prescription, the independent provider is responsible for validating that the prescription is:

• Medically appropriate based on the patient’s medical history, current symptoms, and health status
• Free of contraindications and dangerous drug interactions
• At a safe and appropriate dosage
• Compliant with applicable state and federal law
• Consistent with the provider’s independent clinical judgment and medical ethics

The provider is solely responsible for these validations and for the clinical decision to issue or refuse a prescription.

Ody Health’s role in prescription handling

Ody Health’s role is limited to:

• Receiving prescriptions from independent providers
• Transmitting prescriptions to dispensing pharmacies
• Tracking prescription status and communicating with patients and providers about fulfillment
• Maintaining prescription records and audit trails
• Supporting administrative coordination between providers, pharmacies, and patients

Ody Health does not validate prescription clinical appropriateness, review prescription content for medical accuracy, determine whether a prescription should be issued or filled, set dosages, or make any clinical decisions related to prescriptions. Ody Health does not substitute for the independent judgment of licensed providers or pharmacists.

Prescription transmission to pharmacy

Once a provider issues a prescription, Ody Health transmits the prescription to an independent pharmacy designated by the patient or selected based on the patient’s location and pharmacy network availability.

Prescription transmissions include all relevant prescription information, patient information, and provider information necessary for the pharmacy to validate and fill the prescription. Prescriptions are transmitted securely in compliance with state and federal prescription transmission laws.

Ody Health maintains records of all prescriptions transmitted, including the date transmitted, pharmacy recipient, prescription details, and transmission method.

Pharmacy validation and dispensing

Upon receipt of a prescription, the independent pharmacy is responsible for:

• Validating the authenticity and legality of the prescription
• Reviewing the prescription for accuracy and completeness
• Determining whether the prescription can be lawfully and appropriately filled under state law and pharmacy regulations
• Checking for drug interactions, contraindications, and patient allergies
• Verifying the prescription source and provider identity
• Confirming the patient’s identity before dispensing

The pharmacy may refuse to fill a prescription if the pharmacy determines the prescription is unlawful, inaccurate, inappropriate, or unsafe. The pharmacy will notify Ody Health and the patient of any refusal, and an alternative pharmacy or course of action will be discussed.

The pharmacy is solely responsible for dispensing decisions, medication preparation, labeling, and shipping to the patient. Ody Health does not control or direct pharmacy decisions.

Controlled substance prescriptions

Prescriptions for controlled substances (such as Schedule III substances) are subject to additional state and federal requirements, including but not limited to:

• Provider state licensure and DEA registration
• Compliance with state-specific controlled substance regulations
• Patient verification and identity confirmation
• Prescription documentation and record-keeping
• Compliance with the Controlled Substances Act and implementing regulations

Ody Health ensures that controlled substance prescriptions comply with applicable law before transmitting to the pharmacy. If a controlled substance prescription does not comply with applicable requirements, Ody Health will notify the provider and patient and will not transmit the prescription to the pharmacy until compliance is established.

The independent provider and pharmacy are responsible for compliance with all controlled substance regulations applicable to their licenses and jurisdiction.

Prescription errors and corrections

If a prescription contains an error, incomplete information, or information that raises questions about its legality or appropriateness, Ody Health will contact the prescribing provider to clarify or correct the prescription before transmitting to the pharmacy.

If an error is discovered after transmission to the pharmacy, Ody Health will notify the provider and pharmacy immediately and will request a corrected prescription from the provider if necessary.

If a patient believes a prescription is incorrect or inappropriate, the patient should contact the prescribing provider or pharmacy immediately. Ody Health will facilitate communication between the patient and provider or pharmacy to address the concern.

Prescription refusals and denials

A provider may refuse to issue a requested prescription after clinical evaluation. This is the provider’s clinical prerogative and does not require explanation beyond what the provider determines is appropriate to communicate to the patient.

A pharmacy may refuse to fill a prescription if the pharmacy determines it is unlawful, unsafe, or inappropriate. The pharmacy will communicate its refusal to Ody Health and the patient. Ody Health will work with the patient and provider to identify alternative medications, pharmacies, or solutions if available.

Patient refusal of a prescription or medication is always respected. If a patient declines a prescription after a provider issues it, the patient may request that Ody Health not submit the prescription to a pharmacy.

Prescription documentation and records

Ody Health maintains complete records of all prescriptions received from providers and transmitted to pharmacies, including:

• The prescription details (medication, dosage, quantity, refills, instructions)
• The provider who issued the prescription
• The date and time the prescription was issued
• The date and time the prescription was transmitted to the pharmacy
• The pharmacy that received the prescription
• The patient for whom the prescription was issued
• Any corrections, amendments, or refusals

Prescription records are retained in accordance with Ody Health’s data retention policies and as required by law. State and federal regulations may require prescription records to be retained for extended periods (such as five to ten years for controlled substances).

Prescription records are protected and are accessible only to authorized individuals, including the patient, relevant providers, and pharmacy personnel involved in fulfilling the prescription.

Patient responsibilities

Patients are responsible for:

• Providing accurate and complete medical information during intake
• Disclosing all current medications, allergies, and medical conditions to their provider
• Following the provider’s instructions and guidance regarding medication use
• Informing the pharmacy of any known allergies or medications
• Taking medications only as prescribed and instructed
• Reporting any concerns or side effects to the provider or pharmacist
• Providing a valid shipping address where they are authorized to receive medication

Patients may not obtain prescriptions for another person, transfer prescriptions to another person, resell medications, or use medications other than as prescribed. Violation of these responsibilities may result in refusal of service, account termination, or reporting to appropriate authorities.
